The Tax Reality

California's top marginal rate is 13.3%, applying to income over $1M. Most full-time creators fall into the 9.3%–12.3% bracket. Combined with 15.3% SE tax (on 92.35% of net profit), the total burden can exceed 40% for many California creators.

What California Creators Need to Know

The details that actually matter.

California taxes all self-employment income

Brand deals, UGC retainers, affiliate commissions, AdSense, and gifted product FMV are all taxable as self-employment income in California. The state does not conform to all federal deduction rules, so your federal deductions may not reduce your CA tax bill dollar-for-dollar.

No S-Corp magic bullet in CA

An S-Corp election can reduce federal self-employment tax significantly — but California charges an additional 1.5% franchise tax on S-Corp net income (minimum $800/year). Run the math before electing. For most CA creators under $150k, the overhead often eats the savings.

Quarterly estimated taxes are required

California has its own quarterly estimated tax schedule that differs from the IRS. CA due dates: April 15, June 15, September 15, January 15. Miss one and the FTB adds an underpayment penalty on top of the IRS penalty. Payments are required if you expect to owe $1,000 or more in federal taxes for the year.

Home office and equipment deductions apply

California generally conforms to federal deduction rules for home office, equipment, software, and contractor payments — as long as you have documentation. The FTB is active with creator-adjacent audits in LA and the Bay Area.

Common Questions

Do California creators owe both federal and state self-employment tax?

Federal SE tax (15.3%) applies to net profit from self-employment income — California does not add a separate state SE tax on top of that. But California does tax your net profit as regular income at state rates (up to 13.3%), which compounds the federal burden.

Does California tax gifted products and PR packages?

Yes. If you receive a product or trip in exchange for content, its fair market value is taxable income at both the federal and California levels — regardless of amount. Track FMV of every gift you accept.

Is there a minimum franchise tax for LLCs in California?

Yes — California charges LLCs a minimum $800/year franchise tax, plus an additional fee if gross revenue exceeds $250k. Factor this into whether forming an LLC makes financial sense at your income level.
